These Terms of Service ("Terms") govern your access to and use of the Worn In Fire website located at worninfire.com (the "Site"), including any content, functionality, and services offered on or through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
1. Acceptance of Terms

Worn In Fire provides real-world gear reviews and workwear recommendations based on field testing by a former wildland firefighter. Our content includes product reviews, comparisons, recommendations, and related commentary about work gear, safety equipment, and outdoor apparel. The Site is provided for informational and educational purposes only. We reserve the right to modify, suspend, or discontinue any aspect of the Site at any time without notice.
3. User Accounts and Responsibilities
Certain features of worninfire.com may require you to create an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Worn In Fire immediately of any unauthorized use of your account or any other breach of security.

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Worn In Fire, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may access and use the content on worninfire.com for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
You may store files that are automatically cached by your web browser for display enhancement purposes
You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use
The Worn In Fire name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Worn In Fire or its affiliates. You must not use such marks without our prior written permission.
6. User Content
The Site may allow you to post, submit, publish, or display comments, reviews, feedback, or other content ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content. By posting User Content on worninfire.com, you grant Worn In Fire a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
You represent and warrant that you own or control all rights in and to your User Content and have the right to grant the license granted above, and that all of your User Content does and will comply with these Terms. You understand and acknowledge that you are responsible for any User Content you submit or contribute, and you, not Worn In Fire, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.
We have the right to remove or refuse to post any User Content for any or no reason at our sole discretion. We also have the right to disclose your identity or other information about you to any third party who claims that material posted by you violates their rights.

The information presented on Worn In Fire is based on personal experience and testing by a former wildland firefighter. However, your use of any products, techniques, or recommendations discussed on the Site is at your own risk. We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information, products, services, or related graphics contained on the Site.
THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH worninfire.com ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WORN IN FIRE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE.
WORN IN FIRE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WORN IN FIRE DOES NOT WARRANT THAT THE SITE, ITS SERVERS, OR EMAIL SENT FROM WORN IN FIRE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL WORN IN FIRE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct or death or bodily injury caused by products you purchase through the Site.

10. Termination

These Terms and any dispute or claim arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the United States and the state in which Worn In Fire operates, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal or state courts located in the applicable jurisdiction, and you waive any objection to venue in such courts.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
